Terms and conditions of sale

1. Scope
These terms apply to orders placed on this website with the restaurant Nomiya, operated by NEW NOMIYA (SARL, RCS Nanterre 791 038 995), 211 bis avenue Charles de Gaulle, 92200 Neuilly-sur-Seine: for delivery, takeaway and at the table. Full contact details are given in the legal notice. Placing an order implies that you have read and accepted these terms.
2. Dishes and prices
The dishes offered are those on the online menu, while stocks last: a dish that has sold out no longer appears. Prices are shown in euros, including all taxes; the dine-in price may differ from the delivery and takeaway price, and each ordering option shows its own.
The delivery fee, tiered discounts and promo codes are shown before you confirm your order, which displays the total to pay. A promo code applies under the conditions displayed (minimum amount, end date, number of uses), one per order.
Allergens appear in the dish descriptions where they are stated. For the full list of allergens in a dish, call +33 1 46 37 49 02 before ordering, and mention any allergy in the note for the kitchen. Illustrative photos are not contractually binding.
3. Ordering
You fill your basket, choose how you would like to order and, for delivery or takeaway, the time: as soon as possible during ordering hours, or a later time slot. The summary shows the contents, fees and total. Your order is binding once you confirm it with the button that mentions payment; when paid online, once the payment is accepted.
At the table, your order goes to the kitchen as soon as you send it, with no contact details and no payment: you pay at the end of the meal, and ask for the bill from the table’s QR code.
You are then given an order tracking page, and a confirmation email if you entered your email address. The restaurant may refuse or cancel an order it cannot fulfil (dish unavailable, address outside the delivery area, exceptional closure): it will let you know, and any amount paid will be refunded.
4. Payment
Depending on what the summary offers: online by card, on the secure page of our payment provider Stripe, charged when you order; or on site, by card or cash, on delivery, on collection or at the end of the meal.
5. Delivery and collection
We deliver to the postcodes shown in the summary. The times given (25 to 40 minutes for delivery, around fifteen minutes for takeaway) are estimates and may be longer at busy times; for a scheduled time slot, we aim for the time you chose. Please stay reachable on the number you gave: if the courier cannot hand over your order, they will call you.
For takeaway, orders are collected at the restaurant, 211 bis avenue Charles de Gaulle, Neuilly-sur-Seine. At the table, dishes are served as soon as they are ready.
6. Right of withdrawal
The right of withdrawal does not apply to meal orders: it is excluded for goods liable to deteriorate rapidly and for catering services provided on a specific date (article L221-28 of the French Consumer Code).
7. Cancellation and refunds
To cancel, call the restaurant on +33 1 46 37 49 02 while the order is not yet being prepared: it will be cancelled free of charge. Once it is being prepared, it can no longer be cancelled.
An order paid online and then cancelled by the restaurant is refunded automatically and in full to the card used; the amount appears on your account within 5 to 10 working days, depending on your bank.
Missing, wrong or non-compliant dish: report it on +33 1 46 37 49 02 the same day. We will offer to replace it or refund it. You also benefit from the legal guarantee of conformity.
8. Loyalty
With a customer account, each whole euro paid earns you 1 point, credited once the order has been served, delivered or collected. Points have no monetary value and can be neither exchanged nor refunded.
9. Complaints and mediation

10. Personal data and applicable law
The data needed for your order is processed in accordance with our privacy policy. These terms are governed by French law.
